1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) via the online shop of Lukesthunder GmbH.

3. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking on the order button, you are placing a binding order. Confirmation of receipt of the order is sent together with acceptance of the order immediately after submission by means of an automated email. The purchase contract is concluded with this email confirmation.

All prices are final prices including statutory sales tax. In addition to the prices quoted, shipping costs will be incurred, which will be clearly communicated during the ordering process.

We currently offer Shopify Shop, PayPal, Visa, Mastercard, American Express, and Apple Pay as payment methods.

 

5. Delivery and shipping

We deliver to Germany, the European Union, and internationally. Shipping costs are calculated as a flat rate depending on the country and are displayed during the ordering process. We do not offer free delivery.

Delivery time within Germany: up to 10 days.
International delivery time: up to 30 days.

Note on international deliveries and possible customs fees

Deliveries to countries outside the European Union—especially to the United States of America—may incur additional costs. These include customs duties, taxes, and import fees, which are not included in the total price quoted.

These costs are not charged or controlled by us and must be borne by the buyer. They are based on the respective legal provisions of the importing country. Please check with the relevant customs or tax authorities in your country for possible fees before placing an order.

We accept no liability for delays caused by customs clearance.

6. Right of withdrawal

The goods remain our property until full payment has been received.

The statutory liability rights for defects apply.

9. Liability

We shall be liable without limitation for intent and gross negligence. In cases of slight negligence, we shall only be liable for damages resulting from injury to life, limb, or health, as well as for damages resulting from the breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely. In the latter case, liability is limited to the foreseeable, typically occurring damage.

11. Dispute resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Contract language and choice of law

The contract language is German. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
